Guyana Sugar Corporation may be treading on very thin ice as it is apparently losing the support of the business community as a result of bad credit.Yesterday,World Baseball Classic Jerseys 2017, accounts established at many local business operations have been frozen,Adam Oates Jersey, disallowing the sugar company from gaining credit from these institutions. This newspaper was told that this move was a collaborative measure by some local businessmen following a large accumulation of money owed by the corporation. At present the company is undergoing major changes as it seeks to dispose of some of its assets to save money.Since January, the company has been attempting to cut not only production cost but under the new management, also attempting to curtail spending. One of its most recent moves to save the company money was a proposal to close the communication department within the company.Last year was a very tough year for GuySuCo as the company ended the year with a deficit of more than $3B.Over the years,Corey Brewer Jersey, GuySuCo has consistently been reviewing its production targets,World Baseball Classic Jerseys, including last year’s,Authentic NBA Store, and among the many excuses proffered were far reaching strikes, weather and loss of opportunity.GuySuCo has come in for heavy criticisms over the past year,Supply NHL Gear Store, with its problems being compounded when the arbitration tribunal set up to deal with the wages dispute between the corporation and its workers ruled that the company should pay $1.3B to its workers. This accounts for a six percent across the board payment along with a further 2.1 percent one-off payment as cost of living adjustment for 2008.However,Stitched Buffalo Bills Jerseys, given GuySuCo’s financial constraints, the company has been given until this month to pay the living adjustment to workers.

By Kiana WilburgThe APNU+AFC Government appears to have stayed its hand in the move to sanction those logging companies that have failed to establish facilities which would add value to Guyana’s highly valued woods.Minister of Governance, Raphael TrotmanChinese logging giant, Bai Shan Lin wants two more years to get its long-awaited wood-processing facility up and running and it seems as though this has been granted by the new administration,Benson Mayowa Jersey, regardless of the fact that such a commitment to the Guyanese people had not been fulfilled for over ten years. This was made known yesterday during a post-Cabinet meeting with the press at the Ministry of the Presidency.Minister of Governance, Raphael Trotman, was questioned about his threat some months ago to reveal the action which will be taken by the end of October, should Bai Shan Lin and others fail to make any moves to add value to Guyana’s lumber exports. But up to yesterday, the government seemed to have modified its position against the defaulting company.Trotman said,Brandon Ingram Jersey, “In terms of Bai Shan Lin, we had met with them on successive occasions and we have had discussions with other foreign companies that have been in the forestry sector. Bai Shan Lin as we know and I don’t think it’s a secret that it has not complied in its entirety. I have met with representatives of the China Development Bank who of course are financing Bai Shan Lin.“I am led to believe that the company itself is in the process of restructuring. Then it will reengage with the government, but as for now there has been a pause because there has been a process of restructuring its corporate activities and seeking new financing from China Development Bank.”The Governance Minister also said that when he last spoke with the company (and this was three weeks ago), he was informed that the Chinese logging company was in no position to have the mills that it said it would have imported within the next ten months. As a result of this sad situation for the company he said,Billy Price Jersey, “They have asked for two years and we have had discussions with them about an alternative mill and that is on board. But as I said, much depends on Bai Shan Lin securing the financing.”Bai Shan Lin is the very company which Minister of State, Joseph Harmon,Adam Shaheen Jersey, had said, mimics the behaviour of a bacterium called spirogyra. He had said during the 2015 election season that this “bacterium” gobbles what it wants and keeps splitting and spreading and that is exactly what Bai Shan Lin is doing. He had said, “With the rate at which this spirogyra (Bai Shan Lin) is going, when you get to my age, Bai Shan Lin would have gobbled up everything.“But let it be known that once the laws of the country are breached by foreign or local companies, we will speak about it and we will take action. The level of examination and action to follow will surly arrest this wanton destruction of our forests.”Bai Shan Lin had given conflicting reasons in the past to justify the delay of establishing this wood-processing facility. In fact, Commissioner of the Guyana Forestry Commission (GFC), James Singh a few months ago had also revealed that the company indicated to him that the current holdup is as a result of “financial difficulties.”Singh had explained, “They told us that they have been experiencing some financial difficulties in the sense that they were unable to meet some bench marks for certain lending agencies…We met with them and they had some concerns. They indicated to us that they met with some government officials and are expected to submit a revised programme in relation to the facility to them and wait for it to be reviewed.”He had said, too, that a team from the China Development Bank also accompanied the Chinese company to the meeting. The Commissioner said that he told Bai Shan Lin to make the wood processing facility their “priority.”Singh said that the company promised that once the “financial difficulties” are over, it will also submit the revised programme on the facility to the Commission.A few months ago, Trotman had told the media that the companies this time around will not escape sanctions for should they fail to make good on their promise then their contracts will be reviewed for termination.Trotman who is also vested with some responsibility for the natural resources of the nation had explained that Government will be looking at the concessions that have been granted to certain, if not all companies in the forestry sector.Presidential Advisor on Sustainable Development, Dr. Clive Thomas, had said that the behaviour of the logging companies such as Bai Shan Lin which have benefitted significantly from Guyana’s forest resources is absolutely “unacceptable”.He said too that he will be recommending to the David Granger-led administration for some of their concessions to be taken away.“Guyana cannot continue to be giving out hundreds of millions of dollars worth in these tax breaks or concessions and we aren’t benefitting from value added operations. If companies make a commitment to do so then the ethical thing to do is to deliver what was promised. If not, their concessions should be taken away,” the economist had said.In 2014, BaiShan Lin blamed the Guyana Office for Investment (GO-Invest) for delaying its application for its wood processing factory. In one of its advertisements, the company stated that in 2008, it applied to the “Government of Guyana, through the Guyana Office for Investment (GO-Invest) and other agencies, to lease lands to set up a factory to process logs and engage in value-added production, such as the making of furniture, craft and hardwood flooring.”It had said then that it was experiencing delays.Kaieteur News later reported that GO-Invest had no such application. BaiShanLin had nothing to say when this was revealed. This caused many, including the then opposition, to challenge the previous government to make public the investment agreement it signed onto with the Chinese logging company. This was never done.In April, the company then blamed the “hostile” media reports during 2014 for dispiriting financiers. In a statement, the Chinese company had said that it is concerned about the apparent “misrepresentations and false reports” being carried by some sections of the media on its operations in Guyana. It identified Kaieteur News as the leader of the “hostile” campaign and even cited a KN article with the headline: ‘BaiShanLin delays US$70M wood processing factory for gold, housing,Andre Smith Jersey, logging.’But in its statement, it did not deny that it was approved ‘US$70M’ for certain activities. With regard to the wood processing plant in the Linden area that was to be constructed, BaiShanLin,WBC Jerseys 2017, one of the largest exporters of the country’s prime species of wood,Cheap Soccer Jerseys 2019, had complained that it has indeed suffered major setbacks in completing its wood processing facility that will create hundreds of jobs for Guyanese. It claimed that these “setbacks” directly relate to lack of adequate funding from its financiers, who, since last year “when these sustained attacks began,” became concerned about the “soundness of investing further in what appeared to be a hostile environment.”

By Kiana A. WilburgThe alarming number of civil and criminal cases that have been carried over from 2015 to this year has been highlighted in the latest Annual Report of the Supreme Court of Judicature.Minister of Legal Affairs and Attorney General, Basil WilliamsDuring 2015, a total of 6, 492 civil matters were filed in the Supreme Court Registry, Georgetown; 1207 in the Sub-Registry, New Amsterdam; and 299 in the Sub-Registry Essequibo. This makes a total of 7,998 matters filed. To this must be added the backlog of 2,World Cup Jerseys 2018,595 matters in Georgetown, 4,223 in Berbice, and 868 in Essequibo. This gives a total of 7,686 backlog matters. When this is added to the 7,998 filed in 2015 it gives a grand total of 15,684 matters which were to be heard in 2015.Kaieteur News understands that the Judges heard and determined 4831 matters in Georgetown,Bobby Orr Jersey, 595 matters in Berbice and 203 matters in Essequibo, making a total of 5,629 matters concluded in 2015. This would leave a total of 10, 055 civil matters pending at the end of 2015.The report also notes the concern of the officials of the Judicature regarding the number of civil cases awaiting trial. These cases continue to escalate. The officials said that the staff of the Supreme Court Registry continues its exercise of auditing all matters filed in the Registry by bundling them into categories of matters. These categories are abandoned, deserted, ripe for hearing and pending in the Registry either for pleadings to be closed or for decisions to be delivered by Judges.Matters that are ripe for the hearing are sent to the chambers of the Chief Justice for assignment to judges for hearing. The abandoned matters are also assigned by the Chief Justice to Judges for call over of these cases so that Attorneys-at-law and litigants are given the opportunity to be heard. This is an ongoing exercise. In relation to this exercise last year,Argentina World Cup T-Shirts, 158 Civil Matters were deemed abandoned. This follows the 829 that were completed in 2014, a further 265 in 2013 and 8,Antoine Bethea Jersey,062 in 2012. The number of matters disposed of goes as far back as 2007 in Georgetown and 2005 in Berbice while Essequibo is dealing with current matters. The Supreme Court is also using the Alternative Dispute Resolution (ADR) method to deal with civil matters which is done on a voluntary basis. However, there are plans to make mediation a compulsory step in the civil procedure rules and also to expand the pool of trained mediators available to do mediation. At the end of last year, matters were referred to mediation by Judges of the High Court and through requests by Attorneys-at-Law/clients.As for Criminal cases, it was noted that last year, 73 depositions were filed in the High Court Registry, Georgetown, 35 in the Sub-Registry, New Amsterdam and 16 in Suddie,Authentic Carolina Panthers Jersey, Essequibo making a total of 124 depositions. To this number must be added the pending backlog of 213 in Georgetown, 179 in Berbice and 59 in Essequibo, making a grand total of 451 criminal matters to be heard.According to the annual report, 53 Criminal matters were completed in Georgetown, 16 in Berbice and 11 in Suddie Essequibo. The report said that these indictments reflect matters heard in Georgetown, Berbice and Essequibo for which Preliminary Inquiries (PI) were heard in the Magistrates’ Court.Officials of the Supreme Court noted,World Baseball Classic Jerseys Outlet, however, that the rising number of both civil and criminal cases that are to be heard by the limited number of Judges is disturbing. They said that civil matters, especially, most times involve dealing with complex issues which require hearing of evidence over a number in addition to dealing with authorities cited by Attorneys-at-Law.The officials said, “It is impossible for a Judge to complete 30 civil matters in one session more so, when Attorneys-at-Law are given adjournments too often. It is the hope of the administration that given time and space at the High Court, 20 judges will be able to deal with the backlog of cases positively.”Another problem they said that has to be addressed urgently is the number of cases completed but still awaiting delivery of judgment by judges. The officials said that in some cases,Cheap Nike Basketball Jerseys, delivery of judgment is outstanding as far back as three years.

By Leonard GildariePolicyholders hoping for an early conclusion to the liquidation of the CLICO Guyana are facing another setback with the court on Wednesday ordering a temporary stay of proceedings after the company asked that Chief Justice (ag), Ian Chang, recuse himself from the case. And a top government official, who asked not to be named, said that had government had its way,Supply Cheapest Soccer Jerseys, more than 2,000 policy holders would have been paid by this Christmas.CLICO Guyana, through its lawyer, Roysdale Forde, on Wednesday, was granted the stay of proceedings by Justice Franklin Holder after a Writ of Summons and Ex-Parte Application was filed on last week Thursday. The matter comes up again on January 12.According to the Notice of Motion, Justice Chang should recuse himself because of his “predisposition against the respondent” and possible bias. The motion said that Chang abdicated his duties to convene a sitting of the Full Court to hear an application for a stay of proceedings from a decision given by him on November 19.In the Affidavit of Support, Director of CLICO, Winston Ramalho, said that it was the Chief Justice who had ordered that the company be placed under judicial management in February. The company claimed that “should there be no recusal by the Honorable Justice Ian Chang, S.C, and the court proceeds to order the winding up while this action is pending would result in a change of the status quo from state of Judicial Management to a state of Insolvency with severe and drastic consequences to the respondent.”A top government official yesterday said that the CLICO Guyana situation could also be likened to the ongoing one with Globe Trust which after years is still held up with account holders awaiting their money. In February,Brad Kaaya Jersey, the Guyana government took steps to protect policy holders of CLICO Guyana, placing the running of the company under the watch of Maria Van Beek, Commissioner of Insurance, to act as the Judicial Manager.President Bharrat Jagdeo had made the announcement at a news conference, which was also attended by Van Beek and Dr Ashni Singh, Minister of Finance.“Through the Commissioner of Insurance, the government of Guyana approached the High Court and obtained an order placing CLICO Life and General Insurance Company South America Limited otherwise known as CLICO Guyana under judicial management.”He stated that the legal move followed the financial market developments in parts of the Caribbean, and The Bahamas in particular. That country’s Supreme Court had only a few days before that announcement granted a winding-up order and appointed a liquidator for CLICO Bahamas Limited.A press release from the Office of the Registrar of Insurance Companies said that the order was issued on the application of the Finance Minister and was taken in order to protect the interest of the company’s policyholders. The Bahamian government’s move followed the January 30 takeover of three subsidiaries of the CL Financial Group in Trinidad by the twin-island nation’s government. The companies are Colonial Life Insurance Company (Trinidad) Ltd., CLICO Investment Bank Ltd and British American Insurance Company (Trinidad) Ltd.On Thursday, Jagdeo revealed that his administration had sought updated information on CLICO Guyana’s exposure and discovered that this had been considerable, in particular to the Bahamian company; this, he said,Authentic Buffalo Bills Jersey, flew in the face of instructions over a year ago from Van Beek and even more recently.“Based on the information received, CLICO Guyana has $6.9 billion or approximately US$34 million invested in CLICO Bahamas, which represents 53 percent of the Guyana company’s total assets.“Furthermore,Andrew Wiggins Jersey, CLICO Guyana has not been able to exchange its illiquid assets for more suitable investments despite repeated instructions by the government of Guyana to do so.”The president had stated that although the investments held in CLICO Bahamas were liquid on paper, investigations revealed that the Bahamas company was exposed to real estate investments in Florida through related party transactions with other subsidiaries in the group.Jagdeo added that a comprehensive assessment of the company’s finances will be obtained and greater protection would be offered to policyholders.“Government intends to work towards recovering the sums outstanding from the Bahamas, and to protect the interests of all policyholders of CLICO Guyana. In this regard, policyholders will be contacted and provided with further information shortly.”He acknowledged that there had been sizable claims on CLICO Guyana following the news from Trinidad, resulting in a liquidity strain on the entity.According to Jagdeo, while the company has so far managed to meet its claims, it has been forced to dispose of some of its investments including its shares in the Berbice River Bridge,Swingman Nike NBA Jerseys, which amounts to some $2 billion. The New Building Society has since acquired those shares, Jagdeo revealed.CLICO Guyana and CLICO Suriname,Andre Johnson Jersey, have made claims of US$34mn and US$15.5mn,David Robinson Jersey, respectively, against the Bahamas unit, although they were not its direct subsidiaries.
